  1. In Indian Medical Council Amendment Act, 2016 dated 05-05-2016
“10D. There shall be conducted a uniform entrance examination to all medical educational institutions at the undergraduate level and post-graduate level through such designated authority in Hindi, English and such other languages and in such manner as may be prescribed and the designated authority shall ensure the conduct of uniform entrance examination in the aforesaid manner Indian Medical Council Amendment Act, 2016 dated 05-05-2016 is passed by the parliament of India after the Ordinance by the Hon’ble President of India. The National Eligibility cum Entrance Test (NEET) is now under law and students must have to qualify the exam to get admission in any Medical or Dental College UG/PG throughout the India. Now an extra qualifying exam is added to it, that is NEET- UG/PG. Students have to get 50 percentile marks in NEET Exam. NEET will be just like GATE (Graduate Aptitude Test in Engineering) exam. There is no hard and fast rule that the institutes have to absorb the GATE qualified students from its merit list only. Different IIT institute like Mumbai etc take re-exam of the GATE qualified students to make their own merit list. When NEET occurred in 2013 as per Gazette Notification of MCI vide No. MCI-31(1)/2010-MED 62051 dated15-02-2012 published on 27-02-2012, it was mentioned that Medical/Dental seats must have to fill by NEET rank only. So the Hon’ble SC of India cancelled it by saying NEET unconstitutional. In NEET 2016 law, nowhere it is mentioned that medical /dental seats have to fill from NEET-merit list only, rather it is said that students must have to qualify NEET exam. From this law point of view, the institutes like AFMC Puneand CMC Vellore had been arranged their own Test to shortlist the NEET- UG qualifiers for their own admission in 2016-17 session.
So, the states/deemed universities / pvt. Medical colleges etc. may impose their own entrance test among NEET – UG / PG qualified students.
